1. Acceptance of Terms

By accessing and using Lumethic's photo verification service, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our service.

2. Service Description

Lumethic provides a photo authenticity verification service that analyzes digital images to determine their authenticity. Our service includes:

• Comparison of RAW files with processed JPEG images
• Technical analysis for detection of manipulated or generated content
• Analysis of EXIF data and image metadata
• Generation of detailed verification reports
• C2PA (Coalition for Content Provenance and Authenticity) digital signing of verified images
• Photo marketplace for selling verified authentic photographs

3. User Accounts

To access our service, you must create an account. You are responsible for:

• Providing accurate and complete information during registration
• Maintaining the security of your password and account
• Keeping your login credentials confidential
• All activities that occur under your account

4. User Content and Privacy

When you upload images to our service:

• Images are stored securely and used solely for verification purposes
• Verification results are only shared when you explicitly choose to share them
• We implement industry-standard security measures to protect your content
• You are responsible for ensuring you have the right to upload and verify images
• You retain all rights to your uploaded images
• You grant Lumethic a limited license to process images for verification purposes only
• You warrant that your use of the service does not infringe on any third-party rights
• Your images are never used for AI model training or any purpose other than verification

5. Acceptable Use

You agree to use our service only for lawful purposes and in accordance with these terms. You agree not to:

• Upload content that is illegal, harmful, or violates any applicable laws
• Infringe on the intellectual property rights of others
• Use the service to distribute malware or conduct malicious activities
• Use the service for spam or unsolicited communications

6. Intellectual Property

Lumethic retains all rights to its verification technology, algorithms, and service infrastructure. Our verification reports may be shared by users, but the underlying technology remains our proprietary property.

7. Payment Terms

Our service operates on a freemium model with additional paid tiers:

• Subscription fees are billed monthly or annually as selected
• Additional verification fees apply for usage above plan limits
• Billing occurs automatically on your subscription renewal date
• You may cancel your subscription at any time with effect at the end of the current billing period

8. Marketplace Terms

Lumethic provides a marketplace where photographers can sell verified authentic photographs. By using the marketplace:

As a seller, you agree to:

• Only list photos for which you own all necessary rights and have obtained required releases
• Provide accurate descriptions and ensure photos match their listings
• Be responsible for all applicable taxes on your sales
• Complete Stripe Connect onboarding and agree to Stripe's Connected Account Agreement

As a buyer, you understand that:

• You are purchasing a license to use the photo according to the selected license type
• Licenses are non-transferable and may not be resold

Available license types include:

• Personal License: For personal, non-commercial use only
• Commercial License: For business and commercial applications
• Editorial License: For news, educational, and documentary purposes
• Extended License: For expanded usage rights as specified by the seller

Platform fees:

• Lumethic charges a 15% commission on all marketplace sales
• Sellers receive payment directly to their Stripe account after the commission is deducted
• Refunds are handled on a case-by-case basis; digital license sales are generally non-refundable
• Disputes between buyers and sellers should first be resolved directly; Lumethic may mediate but is not liable for transaction disputes

9. Verification Service Disclaimer

Important information about our verification service:

• Our verification provides probabilistic analysis based on comparing RAW files with JPEG exports; results indicate likelihood, not absolute certainty
• Verification reports are technical analysis documents and do not constitute legal certificates of authenticity
• A successful verification indicates the JPEG likely derives from the provided RAW file, but cannot guarantee the circumstances of the original capture
• Users remain responsible for making their own determinations about image authenticity for their specific use cases
• C2PA signatures attest that Lumethic verified the image; they do not guarantee the image's ultimate provenance or the identity of the photographer

10. API Terms of Use

For users accessing Lumethic through our API:

• You are responsible for maintaining the security of your API keys
• API keys must not be shared or exposed in public repositories or client-side code
• API usage is subject to rate limits based on your subscription plan
• You may not use the API to build a competing service or reverse-engineer our verification algorithms
• We reserve the right to revoke API access for violations of these terms

11. Third-Party Services

Lumethic uses the following third-party services to provide our platform:

• Stripe for payment processing and marketplace transactions (subject to Stripe's Terms of Service)
• Amazon Web Services (AWS) for hosting and data storage in Frankfurt, Germany
• C2PA standard implementation for content credentials

By using Lumethic, you also agree to the terms of service of these third-party providers where applicable

12. Limitation of Liability

Lumethic provides its service 'as is' without warranties of any kind. We are not liable for any damages arising from your use of the service, including but not limited to direct, indirect, incidental, or consequential damages. Our verification service provides analysis based on available data and should be considered as one factor in determining image authenticity.

13. Termination

We reserve the right to terminate or suspend your account at our discretion, with or without notice, for violations of these terms or for any other reason. Upon termination, your right to use the service will cease immediately.

14. Governing Law

These terms are governed by and construed in accordance with the laws of Germany. Any disputes arising under these terms will be subject to the exclusive jurisdiction of the German courts.
